Terms of Service

1. Who we are
Bondis.ai (the "Service") is owned and operated by Sigma Mode (Pty) Ltd ("Sigma Mode", "we", "us"), a private company incorporated in the Republic of South Africa. The following information is provided in terms of section 43 of the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"): legal name: Sigma Mode (Pty) Ltd; place of incorporation: South Africa; website: https://www.bondis.ai; contact: info@sigmamode.co.za. By creating an account or using the Service you agree to these terms.
2. Eligibility
You must be at least 18 years old to use the Service. By using it you confirm that you are 18 or older and have the legal capacity to enter into this agreement.
3. The nature of the Service
Bondis.ai provides conversations with artificial-intelligence companions. Companions are software, not people. Their responses are generated by AI and may be inaccurate, incomplete or fictional. Nothing a companion says constitutes medical, psychological, legal, financial or any other professional advice, and the Service is not a substitute for professional care or human relationships. If you are in crisis, contact a qualified professional or emergency services.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity on your account. Accounts are personal and may not be shared or sold. Tell us immediately at info@sigmamode.co.za if you suspect unauthorised use.
5. Acceptable use
You may not use the Service: for any unlawful purpose; to create or share content that is illegal under South African law; to harass, defame or harm others; to attempt to access other users' data; to reverse-engineer, scrape or overload the platform; or to misrepresent AI-generated content as statements by real people. We may suspend or terminate accounts that breach these terms.
6. Your content and our licence
You retain ownership of the content you create (your messages, companion designs and settings). You grant us a limited licence to process and store that content solely to operate, secure and improve the Service. We claim no ownership of your content and will not publish it.
7. Plans, billing and cancellation
The Free plan is free indefinitely, subject to fair-use limits. Premium is a monthly subscription billed in advance in South African rand and renews automatically until cancelled. You can cancel at any time from account settings; access continues until the end of the period already paid. Where the Consumer Protection Act 68 of 2008 or section 44 of ECTA grants you a cooling-off or cancellation right, nothing in these terms limits that right. Prices may change with at least 30 days' notice before they apply to you.
8. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify features, and will give reasonable notice of changes that materially reduce the Service you pay for.
9. Limitation of liability
To the maximum extent permitted by law โ and without limiting any rights you have under the Consumer Protection Act that cannot be excluded โ Sigma Mode is not liable for indirect, consequential or special damages arising from your use of the Service, and our total liability is limited to the amounts you paid us in the 12 months before the claim arose.
10. Privacy
Our Privacy Policy explains how we handle your personal information under POPIA and forms part of these terms.
11. Termination
You may close your account at any time. We may suspend or terminate accounts that breach these terms, with notice where reasonable. On termination you may export your data as described in the Privacy Policy.
12. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. Disputes will first be addressed in good faith via info@sigmamode.co.za; failing resolution, the South African courts have jurisdiction. Nothing prevents you approaching the National Consumer Commission or other applicable ombud.
13. Changes to these terms
We may update these terms from time to time. Material changes will be posted here with an updated date and, where appropriate, emailed to account holders before they take effect.
